Vibe Kids Terms of Service
Version 1.0 | Effective date: 10/06/2026 | Last updated: N/A
These Terms of Service ("Terms") govern your access to and use of Vibe Kids (the "Service"), including the website, web application, and any related features. The Service is operated by Anchored Imagination LLC ("we", "us", or "our"). We call the Service "Vibe Kids."
You accept these Terms when you check the box and click the button that creates your parent account. That click is your agreement to these Terms and to our Privacy Policy. If you do not agree, do not create an account and do not use Vibe Kids.
Only an adult can accept these Terms. Your child is welcome to use Vibe Kids with you, but your child does not agree to these Terms and is not a party to them.
How updates work. We may update these Terms as Vibe Kids evolves. If we make a material change, we will email the address on your account at least 30 days before the change takes effect, and we will post the updated Terms here with a new "Last updated" date. If you keep using Vibe Kids after a change takes effect, you accept the updated Terms. If you do not agree, stop using Vibe Kids and close your account from Parent → Settings.
1. What Vibe Kids Is
Vibe Kids is a supervised, hands-on learning experience that helps young children (roughly ages 6–10) learn the thinking behind software - rather than the syntax of a particular programming language - by building small, self-contained HTML games and interactive pages together with an AI coding companion ("Vibe").
The Service is not designed for independent use by children. It is built for parents/guardians who log in and learn together with their children. The adult must be present and, for the youngest kids, typically types and guides. The adult is the account holder and is responsible for the session. There is no separate child login.
2. Accounts, Eligibility, and Parental Consent
- You must be at least 18 years old (or the age of majority in your jurisdiction) to create a parent account.
- During our current early-access phase, sign-ups may be gated via waitlist or invitation. We may change or remove this gate at our sole discretion and without notice.
- Parental consent is required. When you create a parent account, you confirm that you are the parent or legal guardian and that your child uses Vibe Kids with you present. We record that confirmation and the exact wording you saw. Separately, we obtain your verifiable parental consent in the way described in Section K of our Privacy Policy. The signup confirmation is not that consent. Your child cannot send a first prompt to Vibe until the consent step in Section K is complete.
- Children do not create accounts, do not agree to these Terms, and are not parties to them. You, the adult, are the account holder and the only person who can accept these Terms.
- You are responsible for keeping your password secure and for all activity under your account.
- Child profiles are created by a parent. Children do not create or control their own accounts and there is no separate child login; the parent selects the active child.
You may not create an account for someone else without authorization, impersonate anyone, or use the Service for any illegal purpose.
Where the Service is offered. Vibe Kids is offered in the United States. It is not directed to or intended for anyone located in the European Union, the European Economic Area, the United Kingdom, or Switzerland, and we block access from those regions. Location based on IP address is not perfect, so if you are in a region we do not serve, please do not use Vibe Kids, whether or not you can reach it.
3. How the Service Works (Key Safety and Supervision Rules)
- You (the adult) must be present to supervise all sessions, guide your child, and decide what is appropriate for your child.
- Do not use the Service to generate, request, or share content that is harmful, illegal, sexually explicit, violent, hateful, or that violates the rights of others.
We may block content, lock, suspend, or terminate accounts that abuse the Service, attempt to bypass the technical safeguards, or repeatedly produce or request inappropriate content. A locked account can contact us to request an unlock at hello@vibekids.app.
4. Your Content, Ownership, and How We Use It
- As between you and us, you and your child own the games and experiences you create ("Your Content").
- You give us a limited license to host, store, process, display, and back up Your Content so that we can run Vibe Kids. You also allow us to review the prompts you type and the games Vibe produces, in order to operate the Service, keep it safe, and improve it. Our Privacy Policy explains exactly how that review works, including the step where we remove information that identifies your child before we use a prompt or a build for product improvement. This license lasts only as long as we hold Your Content under the retention schedule in Section I of the Privacy Policy, and it ends when you delete the content or close your account.
- We do not claim ownership of Your Content.
- You are responsible for ensuring that any content you or the child create (or ask the AI to help create) does not infringe anyone else's rights.
5. The AI Companion and Third-Party Providers
The "Vibe" experience is powered by open-weight ("open-source") AI models hosted by our inference provider, Fireworks AI.
- When you type instructions or the AI generates code, that information is sent to the AI provider to produce the edits. Fireworks AI represents that it applies zero data retention to the models we use, that prompt and generation data are held only in memory for the length of the request, and that the data is not used to train models. We do not route your child's data to AI providers that retain or train on it.
- The narrow single-file boundary above and our render pipeline are the primary safety boundaries, alongside automated safety screening of prompts and output.
- The specific open-weight model may change as we improve quality and speed.
We do not use your family's conversations or builds to train any AI model, ours or any vendor's.
6. Payments and Paid Plans
Some features or usage may require a paid plan.
- Prices, what is included, and any billing terms are shown at the point of purchase. Taxes may apply.
- Unless stated otherwise at purchase or required by law, payments are for the plan or item described at checkout. Contact us with any billing questions.
- Refunds are governed by our Refund Policy.
7. Acceptable Use
You agree not to:
- Attempt to break out of the sandbox or the single-file boundary, access other users' data, or reverse-engineer the safety systems.
- Use the Service to create or distribute malware, phishing pages, or anything intended to harm others.
- Harass, abuse, or intentionally generate upsetting or inappropriate content for or with children.
- Share account access in a way that allows unsupervised or unauthorized use by children.
- Overload or abuse the infrastructure (we have concurrency and rate limits for a reason).
- Use Vibe Kids to build a competing product or to scrape our lessons.
- Use the Service in any way that violates applicable law or the rights of others.
We may remove content and lock or suspend accounts that violate these rules.
8. Privacy
Your use of the Service is governed by our Privacy Policy, which is part of these Terms. Before your child starts, we also send you a separate direct notice that lists what we collect, why, and who receives it, and asks for your consent. The Privacy Policy describes the data we collect from parents and the child profiles they create; how transcripts and builds are handled; that we review prompts and builds to improve the Service; the role of the AI provider; the strong technical isolation we use; and your export and deletion rights.
Because this Service is for young children, we have designed it so that the adult (parent) is the account holder, is present during use, and is the decision-maker.
If anything in these Terms appears to conflict with the Privacy Policy about how we handle your child's personal information, the Privacy Policy controls.
9. Disclaimers and Limitation of Liability
The Service includes AI-generated code and suggestions. AI output can be imperfect, repetitive, or occasionally inappropriate. The supervising adult is responsible for reviewing what is built and deciding whether it is suitable for the child.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT ANY PARTICULAR GAME WILL BE SUITABLE FOR ANY PURPOSE, OR THAT THE AI WILL ALWAYS BEHAVE AS EXPECTED.
Vibe Kids is an educational product. We do not promise any particular learning result, grade, test score, or school placement. Vibe Kids is also in an early-access phase, so features may change, may break, or may go away, and we may pause or stop the Service.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM, OR (b) USD $100.
Nothing in these Terms limits liability for gross negligence, willful misconduct, or fraud, or any liability that cannot be limited under applicable law. That includes rights you may have under the Washington Consumer Protection Act and under other consumer protection laws. Some states do not allow the exclusion of certain warranties or of incidental or consequential damages, so in those states the exclusions above apply only as far as the law allows.
10. Termination
You can stop using the Service at any time. From Parent → Settings you can download a complete export of your family's data as a ZIP file, and you can permanently delete your account. Deleting your account is a complete purge of your family's data, as described in Section L of our Privacy Policy. If you would rather email us, write to hello@vibekids.app and we will complete your request within 30 days.
We may suspend, lock, or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. If we discontinue the Service we will give you reasonable notice where we can, and we will handle any refund under our Refund Policy.
Upon termination, we handle your data according to the Privacy Policy and any legal requirements.
11. Governing Law and Venue
These Terms, and any dispute arising out of or relating to these Terms or the Service, are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules. Any such dispute will be brought exclusively in the state or federal courts located in the State of Washington, and you and we each consent to personal jurisdiction and venue there. Nothing in this section takes away any protection given to you by the law of the state or country where you live. Nothing here affects any right you may have to bring a claim in small-claims court.
12. Changes to the Service or These Terms
We are actively building the product. We may add or remove features, change the AI model, adjust limits, or update the safety systems. We will try, but are not required, to give notice of material changes.
We may update these Terms from time to time. If a change is material, we will email the address on your account at least 30 days before it takes effect, and we will update the "Last updated" date. If you keep using Vibe Kids after the change takes effect, you accept the updated Terms. If you do not agree, stop using Vibe Kids and close your account. Changes apply going forward only. They do not apply to a dispute we already know about.
13. Your Agreement and Electronic Communications
You accept these Terms when you check the box and click the button that creates your parent account. That click is your signature.
You agree that we may give you notices, agreements, disclosures, and other communications electronically, by email to the address on your account or by posting inside Vibe Kids. Electronic communications have the same legal effect as communications on paper.
To receive our communications you need a working email address and a current web browser. You can withdraw your agreement to electronic communications at any time by writing to hello@vibekids.app. If you withdraw it, we may not be able to keep providing the Service, because Vibe Kids runs on the web and account notices go by email. Keep your email address current in Parent → Settings.
14. Your Responsibility for Claims You Cause
If someone brings a claim against us because of something you did, you agree to cover our reasonable costs of defending it, including reasonable attorneys' fees. This applies only to claims that come from: (a) your use of Vibe Kids in a way that breaks these Terms; (b) content you or your child create, or ask Vibe to create, that infringes someone else's rights; or (c) your violation of the law.
This applies to you, the adult account holder. You remain responsible under (b) for content created on your account, including content your child creates. It does not apply to any claim caused by our own gross negligence, willful misconduct, or fraud. It does not apply where the law does not allow it.
We will tell you promptly about any claim we ask you to cover.
15. What We Own
Vibe Kids, the Vibe companion, the lessons and curriculum, the software, the site, and the Vibe Kids name and logo belong to Anchored Imagination LLC or to our licensors. These Terms do not give you any ownership of them.
We give you a limited, personal, non-exclusive, non-transferable license to use Vibe Kids with the children you have enrolled in your household, for as long as these Terms are in effect. You may not copy, sell, rent, sublicense, or publish the lessons or the software. You may not use Vibe Kids to build a competing product. You may not use automated tools to access the Service. You may not use our name or logo without our written permission.
Your games are yours. This section is about our material, not about Your Content. Section 4 covers Your Content.
About AI output. As between you and us, you and your child own what Vibe builds with you, and we do not claim it. We cannot promise that work made with AI can be registered for copyright.
16. Subscriptions and Automatic Renewal
If we offer a plan that renews automatically:
- Before you pay, and right next to where you agree, we show you that the plan renews automatically, how often, the amount we will charge, and how to cancel.
- You must agree to those renewal terms affirmatively before we charge you.
- After you buy, we email you a confirmation that repeats the renewal terms, the cancellation policy, and how to cancel.
- You can cancel online at any time from Parent → Settings, using one clear link, without calling us, emailing us, or answering questions first.
- We send you a reminder before a renewal where the law requires one.

18. General Terms
Severability. If a court decides that any part of these Terms cannot be enforced, that part will be narrowed only as much as needed, or removed, and the rest of these Terms stays in effect.
Entire agreement. These Terms, together with our Privacy Policy and our Refund Policy, are the whole agreement between you and us about Vibe Kids. They replace any earlier version and any other understanding about the Service.
Assignment. You may not transfer these Terms or your account to anyone else without our written permission. We may transfer these Terms to another company if Vibe Kids is sold, merged, or reorganized.
No waiver. If we do not enforce part of these Terms right away, we have not given up the right to enforce it later. A waiver counts only if we put it in writing.
Notices to you. We send notices to the email address on your account, or we post them inside Vibe Kids. A notice is given when we send it.
Survival. After your account ends, the following stay in effect: the sections on Your Content, disclaimers and limitation of liability, governing law, dispute resolution (if included), your responsibility for claims you cause, what we own, and these general terms.
No third-party rights. These Terms do not give rights to anyone other than you and us. Your child is welcome to use Vibe Kids with you, but your child is not a party to these Terms and does not get rights under them.
Things outside our control. We are not responsible for a delay or a failure caused by something outside our reasonable control, such as a network outage, a provider failure, a natural disaster, or a government action. This does not affect your right to a refund under our Refund Policy.
